Are You an Interviewing Pro???

Thinking about hiring additional seasonal help?  Hiring new staff for the new year?  You’ve been down this road before and probably have a good approach to interviewing.  As you add staff, you need an employee handbook but here’s a quick quiz to make sure you’re compliant with your questioning.

Which of the following questions would you use in your hiring process? Read carefully:
•  Are you a US citizen?
•  How old are you?
•  Do you have any disabilities?
•  Have you ever been arrested?
•  If you get pregnant, will you continue to work, and will you come back after maternity leave?

 

Here are your answers:
•  Are you a US citizen? Don’t ask it!  All you need to know is whether a candidate is eligible to work in the US.  (exceptions are Federal jobs and anything requiring a security clearance but that’s not the majority)

•  How old are you? NOPE!!!  If it’s a job with an age minimum like bartending, you just need to know they are over a certain age, ie, 21.

•  Do you have any disabilities?  NOPE!  All you need to do is hand the applicant a job description that contains the physical tasks required of the job (we should all have these) and ask if they need any accommodations….that’s all…..end of story.  

•  Have you ever been arrested? AH, the sucker punch….sorry!!!  Arrest does not imply guilt….just because a person was arrested does not mean they were guilty.  The question to ask on a job app is, “Have you ever been CONVICTED of a crime?”

•  If you get pregnant, will you continue to work, and will you come back after maternity leave?  Don’t even think about it….employers need to provide FMLA benefits (if they are large enough) regardless and the employee does not need to let the employer know until those benefits are expiring.  This is the case even if the company is not subject to FMLA.
